Terms and conditions of the online store

General information:

  1. In the regulations, we use the terms:
    1. Seller – Purpir Technologie Sp. z o.o., ul. Skoroszewska 3/41, 02-495 Warsaw, KRS: 0001027088 NIP: 5223253628. Hereinafter referred to as PURPIR
    2. Buyer – any person, legal entity, or organizational unit without legal personality that places an order in our store
    3. Store – online store at https://purpir.pl/shop
  2. These terms and conditions describe the rules under which products and services are sold in the online store.
  3. The Terms and Conditions are part of the agreement for the sale of products in our store.
  4. If the Buyer wishes to make purchases in the store, write a comment, or use other features of the website, they must read and accept these terms and conditions.

Store products:

  1. Each batch of polyurethane systems manufactured by PURPIR is checked in accordance with an internal technical parameter verification procedure. The products are supplied as two-component liquid systems, the quality of which must be assessed in accordance with the technical specifications available prior to purchase.
  2. PURPIR sells products that are displayed in the store.
  3. As the Seller, we are obliged to deliver goods free from defects to the Buyer. The seller is responsible for the conformity of the services in accordance with the contract concluded by the buyer.

Store Activities:

  1. In the Store, the Buyer has the option to:
    1. go shopping
    2. take advantage of individual discounts
    3. participate in promotions and contests
    4. write reviews about them
  2. To shop in the Store, the Buyer does not need to register in it.
  3. If the Buyer registers an account in the Store, it is also possible to check the transaction history.
  4. You can register for an account free of charge in the store, at https://purpir.pl/shop. During registration, please accept the terms and conditions. The seller will send confirmation of account registration by email.
  5. You can always delete your account in the store. To do so, the Buyer should send an email to: shop@purpir.pl, from the email address assigned to the Buyer's account.
  6. The Store's website is functioning correctly if :
    1. The buyer uses the latest version of Chrome, Firefox, Microsoft Edge, Safari, or Opera.
    2. The buyer has JavaScript enabled in their browser.
    3. The buyer has enabled cookies and website data in their browser.
  7. Complaints related to your account in the store can be sent to: shop@purpir.pl
  8. The complaint will be processed within 30 days of the date of notification.
  9. The Seller has the right to block and report to the competent law enforcement authorities any activities that disrupt the functioning of the store, violate the security of the system, and lead to obtaining unauthorized benefits: the use of bots, scripts, web crawlers, scraping tools, and other automated processes to access information, collect data, automate purchases, participate in promotional campaigns, or interfere with the operation of our store in a manner inconsistent with its intended purpose.
  10. If the Buyer disagrees with the decision, they have the right to send an explanatory message to shop@purpir.pl within 30 days of receiving the email. The Seller will respond to the explanation and inform the Buyer of their decision.

Product sales:

  1. Products sold: in-store, by email, during a conversation with a consultant (by phone)
    1. Orders can be placed via the website https://purpir.pl/shop, by email, or by phone.
  2. There are two ways to do this in the store:
    1. through the account
    2. without creating an account – if the Buyer accepts the terms and conditions each time.
  3. To shop in a store:
    1. read the product information
    2. add products to cart – if available
    3. select delivery method
    4. choose a payment method
    5. enter recipient details
    6. check your order summary
    7. place an order using the “Buy and pay” button”
  4. In exceptional cases, products are marked as special offers.
  5. Confirmation of the contract is sent to the email address provided in the order.

Delivery:

  1. Products are delivered in a manner specified by the buyer.
    1. by courier
    2. Parcel locker (Inpost).This is a courier service that delivers parcels to a designated parcel locker. Parcels can be collected using a code received via text message or an app.
  2. or personal collection after prior arrangement by phone or email
  3. The delivery cost is specified when placing the order.
  4. If the Buyer notices that the shipment or its contents are damaged or incomplete (even if the packaging is intact), they should file a complaint with the carrier.   5. After placing an order, shipments are sent within 24 hours (1 business day). In exceptional cases and for individual orders, the delivery time may be extended to several business days.

Payments:

  1. The prices of all products in the store are given in Euro. The prices quoted are gross prices, i.e., they include VAT.
  2. The price of the product does not include shipping costs.
  3. The order can be delivered:
    1. by courier – you can pay:
      1. online by instant transfer,
      2. by card,
    2. to a parcel locker and pickup point – you can pay:
      1. online via instant transfer, card, Blik or via online prepayment,
      2. by traditional bank transfer,
  4. Invoices are issued and sent electronically.
  5. Each electronic invoice will be delivered to the email address provided during registration.
  6. If the email address changes, the Buyer should notify us in writing or by email.
  7. If this is not done, messages sent to the Seller's current email address will be treated as correctly delivered.
  8. The store is not responsible for incorrect data on the invoice if such data is provided by the Buyer during registration or when placing an order.
  9. Each time an order is placed, you can opt out of receiving an electronic invoice. If you wish, the store will issue and send a paper invoice.
  10. If the Buyer withdraws from the contract or when the store approves a complaint, such as the Buyer choosing a refund, the Seller will make such a refund using the same method in which the payment was made.

Right to withdraw from the contract:

  1. In the case of products modified to suit customer requirements, as well as for bulk orders, the right to withdraw from the contract does not apply, in accordance with applicable regulations.
  2. Purchases in the store can be made by both:
    1. consumers – natural persons making purchases for purposes not directly related to their business or professional activity,
    2. entrepreneurs with consumer rights – natural persons conducting business activity who make purchases not directly related to the nature of their business (within the meaning of Article 38a of the Consumer Rights Act),
    3. other entrepreneurs and legal entities – acting professionally or as part of their business activities.
  3. The right to withdraw from a distance contract without giving any reason within 15 days is reserved exclusively for:
    1. consumers and entrepreneurs with consumer rights (if the nature of the purchased goods is not related to their main professional activity, which can be assessed, for example, based on the PKD (Polish Classification of Activities) entered in the CEIDG (Central Registration and Information on Business).
    2. Other entrepreneurs (e.g., companies, legal entities, firms) do not have the right to withdraw from the contract unless this has been individually agreed in writing with the supplier prior to the conclusion of the contract.
    3. To exercise your right of withdrawal, you must submit a statement in one of the following forms:
      1. Email to shop@purpir.pl
  4. PThe right of withdrawal does not apply in the following cases:
    1. products with secure packaging or seals that have been tampered with after delivery,
    2. products manufactured according to individual customer specifications or serving their individual needs (e.g., modified systems, custom-made foam blocks),
    3. wholesale purchases – that is, more than one set of products within a single or related orders. Such purchases are treated as made within the scope of professional activity and exclude the possibility of withdrawing from the contract.
  5. The returned product must be sent back immediately, no later than 14 days after submitting the withdrawal statement. The product must be in an unchanged condition, unused, in its original packaging.
  6. If you purchase a set of products, you can only return the entire, undivided set.
  7. In the event of withdrawal from the contract, transport costs shall be borne by the customer.
  8. The supplier has the right to refuse to accept returned goods if:
    1. the product is mechanically damaged, contaminated, or incomplete (missing accessories, documentation, or components),
    2. modifications or use of the product have been identified,
    3. the product was not properly secured for return shipment and was damaged in transit.

Complaints and liability:

  1. Submitting complaints
    1. Quantity complaints (e.g., missing goods) and mechanical damage must be reported immediately after receipt of the shipment, under penalty of losing the right to file a claim.
    2. Quality complaints must be reported within 7 calendar days of the delivery date. Failure to report within this period means unconditional acceptance of the goods by the Buyer.
    3. Complaints regarding hidden defects must be reported no later than 14 days after their discovery, but no later than 3 months from the date of purchase, or sooner if the technical documentation or warranty card specifies a shorter shelf life or warranty period.
  2. Scope of complaints regarding polyurethane systems
    1. Complaints will only be considered if the two-component system (components A + B) is found to be inconsistent with the parameters specified in the official technical documentation (TDS specification, safety data sheet) provided by PURPIR Technologie sp. z o.o.
    2. The manufacturer keeps a reference sample of each batch for the duration of its shelf life. After this period, complaints will not be considered due to the inability to verify the product. In addition, the customer declares that the system has been stored and used in accordance with the manufacturer's documentation. Failure to comply with these conditions will result in the complaint being rejected.
    3. The advertised product must comply with the reference sample stored by the manufacturer for each batch. In the event of a discrepancy, the result of the expert opinion based on the reference sample shall be decisive..
  3. Complaints will not be considered if the product has been damaged or modified as a result of:
    1. improper storage,
    2. improper use or dosing,
    3. contamination with foreign substances,
    4. application not in accordance with the technical instructions or environmental conditions, exceeding the shelf life.
  4. Complaints submitted after the warranty period has expired or after the expiration date specified by the manufacturer will not be considered.
  5. Complaint procedure
    1. Complaints should be submitted by email to shop@purpir.pl.
    2. After submitting a complaint, the customer will receive a reference number and further instructions.
    3. The customer is obliged to provide:
      1. batch number, date of purchase, storage conditions,
      2. samples of components A and B,
      3. The goods subject to complaint and the required samples should be delivered at your own expense to the following address: PURPIR Technologie sp. z o.o., ul. Stołeczna 99, 05-083 Feliksów/Zaborów.
      4. The costs of return transport shall be borne by the Buyer, regardless of the outcome of the complaint, unless PURPIR Technologie sp. z o.o. expressly decides otherwise.
  6. If necessary, tests are carried out in the manufacturer's laboratory. The submission of the expert opinion does not automatically mean that the complaint will be accepted.
  7. If the complaint is accepted, the customer will receive information about the rules for returning the product and the purchase costs.

Limitation of Liability:

  1. PURPIR Technologie sp. z o.o.'s liability for any claims is limited to the value of the purchased product.
  2. The Seller shall not be liable for:
    1. indirect damage,
    2. lost profits,
    3. downtime costs,
    4. production damage incurred by the Buyer or third parties.
  3. Responsibility in the delivery process
  4. Partial deliveries and partial invoicing are acceptable for bank transfer payments. Please contact us by email or phone.
  5. The buyer is responsible for unloading the delivered goods.
  6. Transport to the destination, installation, and connection of products are carried out at the expense and risk of the Buyer, in accordance with the technical information provided by PURPIR Technologie sp. z o.o.
  7. Any storage of goods on the Buyer's side is at their expense and risk. The buyer is obliged to ensure appropriate storage conditions in accordance with the technical documentation.

Privacy and personal data:

  1. The Seller processes personal data in accordance with applicable law and our privacy policy.
  2. The privacy policy is included in the appendix to these terms and conditions.
  3. The Seller processes personal data when:
    1. The buyer shops in the store. Data is processed when we handle transactions and services, during shopping,
    2. The buyer uses other services that are available in our store.
    3. The buyer agrees to marketing activities to notify them of promotions and new products.
    4. The Seller has a legitimate interest in processing the Buyer's data (e.g., claims, complaints).
  4. The Buyer provides their data voluntarily. Please note that if they do not provide it, it will not be possible to offer products and provide services.
  5. The administrator of personal data is:

  6. The Buyer always has the right to access their personal data – within the limits provided for by law. You can correct, delete, restrict their processing, or object to the processing of your data. You have the right to transfer your data and lodge a complaint with a supervisory authority. You can withdraw your consent at any time, which does not affect the lawfulness of data processing prior to its withdrawal.
  7. The rules according to which we process personal data are described in our privacy policy.

Changes to the rules:

  1. The Terms and Conditions are subject to Polish law and European Union law. Any disputes arising in connection with the use of the store or the performance of the contract shall be settled by the court competent for the registered office of PURPIR Technologie sp. z o.o.
  2. If the Seller changes these terms and conditions, they will make them available in the store at least 7 days before the new terms and conditions come into effect.
  3. The exception is a situation in which:
    1. the immediate change is required by a legal or regulatory obligation,
    2. to protect against fraud, malware, spam, data breaches, or other cybersecurity threats.
  4. Orders placed by the Buyer before the new terms and conditions come into effect will be processed in accordance with the previous rules.

  6. The amendment to the terms and conditions does not affect the acquired rights of users who use our store.

  1. Our website collects information using Cookie files – i.e. session, permament and third parties.
  2. Collect cookies help in proper website handling.
  3. User can modify cookie collection in Web browser settings.

Usage of Cookie files:

  1. User data cannot be used by automation systems that resolve in decidion making without human interaction.
  2. User data may be used to personalize content or offer on our website.
